Jonathan Lux will highlight the manner, in which mediation can be used during both court proceedings and the arbitral process, in order to achieve successful outcomes for clients. At the beginning, Jonathan will review the way, in which the court’s procedures

can be used to encourage the parties to engage in mediation.

Then, the question whether an arbitration tribunal has the same power as the court stay of proceedings, so as to enable mediation to take place, will be further examined. He will also consider recent cases on multi-tier dispute resolution clauses and analyze how the courts have given effect to the public interest in encouraging parties to engage in friendly discussions before launching litigation. Finally, Jonathan will then contemplate, by reference to the relevant rules of the major bodies the manner in which procedures

can be structured, so as to ensure that a joined up system is achieved embracing both arbitration and mediation.
